A Jury Ready to Hang
August 17, 2010 - 1:22 PM | by: Mike TobinThe reporters are now in a frenzy in Chicago’s Dirksen federal building. They are prepping with the prediction that we will soon get final word from what promises to be a partially hung jury.
This in response to the jury questions just read in Judge James Zagel’s courtroom. One of their questions asked how they should fill out the jury form if they failed to reach agreement on a count. The form only allows for an answer of guilty or not guilty. Judge Zagel instructed them to add a note to the questionnaire, which indicates the lack of unanimity without telling the mathematics of the split, then leave the count blank.
The other question from the jury was if they could get a copy of the oath they took when first seated as potential jurors. The Judge granted that request. It is interpreted as either request from a panel of tired jurors who want to be certain that they filled their obligations before quitting. Or Jurors who want to use specific language to settle a spat.
“They’ve gone as far as they can go,” Said Michael Ettinger, attorney for Robert Blagojevich.
Judge Zagel instructed the lawyers to be certain that Rod and Robert Blagojevich traveled no farther than a half hour away from the Dirksen building.
We know these jurors agreed on 2 counts. They could have agreed on more since telling the judge that last Thursday. It seems clear now, they cannot agree on all the counts.
