Blagojevich Attorneys: Obama Could Testify

Rod Blagojevich Attorneys for former Illinois Governor Rod Blagojevich may try to call President Barack Obama as a witness in the corruption case against their client, although they admit it would be tough to get him to testify.   Attorney Sam Adam excitedly described the possiblity as “the highlight” of his career.  Blagojevich’s lawyers were talking after a hearing before Federal Judge James Zagel on charges of racketeering.  Blagojevich is accused of trying to sell or barter Obama’s former senate seat.  He has denied any wrongdoing and the White House has said it knew nothing of Blagojevich’s plans. 

Judge Zagel gave prosecutors until January 8 to respond to defense lawyers request for “discovery”.  The defense wants to see the FBI’s evidence against Blagojevich, including any transcripts of interviews conducted with President Obama, White House Chief of staff Rahm Emanuel, White House Senior Advisor Valerie Jarrett, and others.  

The prosecution is also expected to recast its’ indictment against Blagojevich filed with the U.S. Supreme Court, under the violation of what’s known as “honest services”.  The government will have to go before a grand jury in order to add additional charges.  The defense says that could delay the trial beyond its’ scheduled June date.

Zagel also addressed a letter the defense wrote complaining that the prosecutor’s negative public comments “might affect the interest of their client…”  Zagel cautioned attorneys that to dwell on specific comments might not be a good idea, that  ”The sooner it escapes the public memory, the better it is for your client”.
