“Sleeper Agent” Stays In Prison For Now

Eight years 4 months.  That's the sentence a federal judge handed down to a man called a "sleeper agent" for Al Qaeda.

 

Ali Saleh Kahlah al-Marri could have gotten 15 years in prison on a charge of "conspiracy to provide material support and resources to a foreign terrorist organization".  U.S. District Court Judge Michael Mihm decided to give credit for the 71 months al-Marri spent in a Navy brig, and time held as a material witness.  In addition, Mihm credited him with 9 more months, to make up for the harsh treatment of al-Marri while he was in custody.

 

If the US prison system also gives him credit for the time held before and after the brig, defense attorneys say he may only wind up with less than 5 years behind bars.

 

Al-Marri, a 44-year-old Qatar native, has admitted training in Al Qaeda camps and then traveling to the United States to offer his help to terrorists after the Sept. 11 attacks.   The government says he was also researching cyanide and other poisons, and obtaining maps of bridges and waterways at that time.

 

"He was the one who prepared himself to be an ideal candidate for al Qaeda" said prosecutor Joanna Baltes.

 

Al-Marri, in court wearing a white cap, a long grey beard and ponytail, smiled occasionally and spoke to his attorneys while watching the proceedings closely.

 

Defense attorneys had hoped their client would be walking free today. The defense argued their client has served enough time, and based on the length and harshness of his incarceration, has been punished enough.

 

Al-Marri was arrested in 2001 and deemed an enemy combatant in 2003.  He spent about  5 1/2 years in a military prison, mostly in solitary confinement and another 18 months in a civilian prison.

 

There was an emotional moment in court when al-Marri read a statement asking the judge for leniency, saying "I am sorry for providing assistance for those who would do this country harm." He cried as he talked about missing his wife and 5 children and claimed he is a "changed person" saying to the judge "I hope you will look with an eye of mercy on me today".

 

The defense also attempted to portray al-Marri as a family man as they showed a video in court of al-Marri's children singing.

 

 On the first of two days of sentencing, defense attorneys brought out two witnesses to back up their claims that treatment at the brig was, in the words of defense attorney Lawrence Lustberg "like torture" and "punishment enough".

 

The first witness, Sanford Seymour, an employee at the Naval Consolidated brig in South Carolina, testified al-Marri was kept alone in a tiny locked room, with no mattress, no reading material and no glasses for the first few years and was denied simple things, like toilet paper. His lawyers say this lead to mental and physical suffering.  To back it up, somewhat disturbing video was shown of al-Marri in his cell, pacing in circles and then laying underneath the metal bed.

 

Prosecutors brought out a witness of their own: military psychologist Deborah Sirratt, who met regularly with al-Marri beginning in 2006.  Sirratt said al-Marri told her he believed "infidels should be killed" and that he "talked about violence against Americans and Israelis." Sirratt said, it's likely al-Marri "would engage in hostile acts against the U.S.," although on cross examination, Sirratt admitted, its been more than a year since she last spoke to him.

 

Judge Mihm agreed with Sirratt assessment, saying he believes the risk of al-Marri committing a violent act is very high.  "I think September 11th was the defining moment for you...that's when you decided to remain part of the conspiracy...to harm American citizens",  Mihm said.

If our framers of the Constitution could see what's going on in THEIR country, I can assure you there would be over 500 hangings on the White House lawns. This is treason in every respect of the meaning. So the judge is telling every American alive that this killer has been rehabilitate, seen the light, mended his ways and will now be a G-d fearing man? This judge should be hung for treason too! Only an ignorant, stupid self centered idiot could come up with the crap he's said about this man! A "family man".......gee that makes a whole lot of difference....what about all the "FAMILY MEN & WOMEN" that were killed in one day? Has this country sunk so low and become so afraid that we'll look away from fear of hurting someone's feelings?? I was once a proud American.......but the America I was proud of ceased to be after Vietnam. Whimps. I think it's time for the baby boomers to take up arms and get this country back in shape. Just one man's opinion.

I think Obama should commute his sentence and quickly name him as the Al Qaeda czar. He should fit in nicely with the rest of the radicals in the group. q

Shameful!!!!!! Why are all these terrorists here in the US? Because of our Liberal "open door policies"! Pull our troops from Afganistan and Iraq. Utilise the Military to protect our borders and go door to door and pick them all up and get them the F**K out of our country! Who cares if they cut each others heads off. Give them each a sword when they exit the plane back in their own countries! And if anyone needs to come here from these countries in the future for any reason, put a tracking device on them. How about some more secure passports in this day and age? We've let enough people into this country. It's time to learn English or leave, and it's way past the time we should have been helping our own people! I feel bad for all the young people who have another 60-70 years to see What's Coming! GOD BLESS AMERICA!

Perhaps Judge Michael Mihm will consider bringing al-Marri's wife and 5 children to his home town for relocation. He could move him in next door. I would only agree with that. However, would it be restitution enough, for the U S putting him in jail for helping kill 3,000 people on American soil ?????? Let's ask The White House ??

What did liberal policies contribute to the 9/11 attacks? If you ever watch the Bin Laden tape where he talks about our weakness shown through then President Clintons actions not to take his life in the tomahawk cruise missile attack in Afghanistan (Bin Laden called him a coward with no principles), all because Clinton believed the terrorist training camp 'got the message', and killing them wasn't the way to get them to love us. This was a liberal policy, just as this judge presented a liberal policy of 'He served the time, he got the message.'. The Marines have a good saying to resolve this situation - Kill them all and let God sort them out...

Punishment for all crimes are meant to serve TWO purposes: 1st, as a punishment for the individual that commits the crime, but MOST importantly as a deterrent to discourage/prevent others from repeating the same crime. The prevention of future crimes is far more important than punishing a criminal for a past act. Criminal punishment never prevents all future crimes from happening and never will, BUT if it only prevents just ONE person from committing the same crime, than that is success enough. 99.9% of people don't commit crimes because of their morals and character, they don't commit crimes out of fear of the punishment.

As an American, decisions like this make me ashamed. Decisions like this show our enemies our weaknesses. It's like you can plan attacks which ultimately will kill many Americans and all you will get is a slap in the wrist. When we get attacked again and thousands of innocent people die will we wake up. Maybe not even then, this country is way to liberal for criminals. As a criminal/terrorist you have a fighting change to get away with homi/genocide. God Help us!
