SCOTUS To Rule On Gun Rights

September 30, 2009 - 6:25 PM | by: Robert Lee

The Supreme Court ruled on Wednesday to decide whether the Second Amendment  applies to "gun ban" laws.

It choose a Chicago case in which Otis McDonald and others have filed suit against the City of Chicago.

The question presented, " Whether the Second Amendment right to keep and bear arms is incorporated as against the States by the Fourteenth Amendment's Privileges or Immunites or Due Process Clauses."

The statement of the case;

The City of Chicago enforces a handgun ban identical to that struck down by this Court as a violation of Washington D.C. resident's Second Amendment rights. The Fourteenth Amendment guarantees that fundamental individual rights may not be violated by any form of government throughout the United States. Accordingly, Chicago's handgun ban must meet the same fate as that which befell the District of Columbia's former law.

The Constitution, and the Bill of Rights, are clear. The Bill of Rights (part of the Constitution) apply to the rights we have as individuals; these rights pre-date the Constitution. The Constitution covers all US Citizens throughout the USA.

The Supreme Court really has no choice but to rule in favor of the 2nd Amendment, failure to do so would render any Federal Law as void within any State's territory. The Constitution is not a buffet where you can pick out the parts you like and ignore the rest.

According to wikpedia, approximately 1,500,000 people are in the US Armed Forces. Approximately 535 people make up all of Congress. Approximately 683,396 police officers/law enforcement officers are in the US. Approximately 270 million people in the US own firearms. That's 268 million ahaead in terms of private citizens owning firearms. What are the odds that gun confiscation would occur even if the Supreme court ruled gun ownership unconstitutional? What army in their right minds would consider slaughtering its own citizenry to take the guns away? What citizenry in its right mind would allow their gun rights to be eliminated? Only one that would let it happen and be too scared to do anything about it. Can the government make such a law? YES. Can they enforce it? LOOK AT THE NUMBERS!

Funny how a city that ban guns for its law abiding citizens, can't protect the populace from violence - to wit; the young honor student senslessly beaten and murdered last week. An armed society is a polite society - perhaps had the perps been raised ot be polite, at least one young person might still be alive. How bad is Chicago's gun crime rate????

Chief Justice John Roberts, having been schooled under Justice William H. Rehnquist, has patiently waited for the correct time and has picked the perfect case to rule on the incorporation of the 2nd Amendment into state and local jurisdictions as an individual right.

All people have an inalienable right to self protection. In the US our second amendment guarantees us of this right. No government agency local, state or federal can take that away. As for me and my family we choose self defense over defenselessness. Any state that rules against the U.S. constitution should be have to leave the union.

I would really hope that the court would uphold our constitutional rights, if they do not than it is a true political decision by the court to play politics and ignore the constitution. If this happens it would be the people’s duty to consider them nothing more than political hacks and disregard their decisions as unconstitutional.

GOD I love living in TEXAS. As law abiding CITIZANS I can own as many guns as I want. I choose to carry my gun were ever and whenever I want. As an Police Officer a encourage “Law abiding citizens” to exercise their rights given to us by our for fathers and paid for with the blood of patriots. I am not afraid of a armed citizen. It is a great responsibility to wield a weapon but it also a RIGHT.

Perhaps the Supreme Court will rule that: "The right of the citizens to keep and arm bears shall not be infringed". (We better all be careful if grizzlies and polar bears start carrying machine guns!).

Putting convicted violent criminals out on islands is a great idea. My selection would be desert islands with hundreds of miles of ocean in all directions. Maybe use some old military target ranges for that purpose. The "guards" could live in nice air conditioned fortified barracks and make sure the water and food is provided regularly for humanitarian reasons. But if the convicts get violent with each other, lock down the barracks and keep the guards safe. Supplies and fresh guards could arrive on a 30 day rotation or more frequently in and emergency.

I am an almost 70 year old woman. I have a 38 revolver and a concealed weapons permit. Heaven help the person who tries to come into my home. He will leave feet first! That includes anyone who comes in to forcibly try to take my gun!

We need people like Sheriff Joe from Arizona in a position to harness and control the thugs that have been arrested. Puting criminals in social instutions called jail is a farce. Lock them up in barbed wire enclosures with pink underware and house them in tents. F__k all civil rights lawyers and put them there too. When this country learns to punish crime instead of giving criminals rights then we will start to end crime.

How about every one at the age of 18 male and female that is a legal Citizen of the United States be required to join the Armed Service of the States. For two year period and the training is nothing but the operation and usage of rifles and hand guns. At the end of the two year training they are required by law to carry a weapon at all times and caught with out a weapon would be the same fine for not having a driver’s license or some form of ID. Now that would be gun control.
